This Privacy Policy explains how surely + work (“we”, “us”) collects, uses, and protects personal information when you use surelywork.com (the “Site”). By using the Site, you also agree to our Terms of Service.
Who we are
surely + work (Surely Work, Inc.) operates a white-glove creative staffing platform that connects clients with vetted creative talent. We act as a facilitator between freelancers and clients, not as the employer, agent, or counterparty to any engagement between them.
What we collect
When you submit an application, create an account, or otherwise use the Site, we may collect:
- Your name and contact information (email, phone)
- Your location, primary role, and the rate ranges you have shared
- A short bio and portfolio links you provide
- Profile photos, work samples, and other media you upload
- Account credentials (when you sign in via magic link or Google)
- Payment information processed by our payment provider Stripe (we do not store full card numbers ourselves)
- The IP address your submission was sent from (used to prevent abuse and rate-limit)
- Information about how you use the Site (pages visited, features used) for product improvement
We do not collect government-issued identifiers or sensitive personal data through the application form.
How we use it
We use the information you submit to:
- Evaluate whether you are a fit for the project you applied to
- Store your profile in our curated creative database for consideration on future projects
- Contact you directly about matching opportunities
- Provide and improve the Site, including troubleshooting and support
- Process payments and remit funds (via Stripe)
- Comply with legal obligations (tax reporting, fraud prevention, court orders)
We do not sell your information. We do not share it with third parties for their own marketing purposes.
Who can see your info
Your submission is visible only to surely + work curators and the client whose project you have applied to, and only if we shortlist you for that engagement. Your profile becomes part of our internal database, which is used for matching across projects. Contact details are never published publicly without your explicit permission.
Third-party processors
We use the following third-party services to operate the Site. They process your data only on our behalf and under our instructions:
- Stripe (stripe.com): payment processing
- Resend (resend.com): transactional and marketing email
- Twilio (twilio.com): SMS delivery (only if you opt in)
- Vercel (vercel.com): Site hosting
- Neon (neon.tech): database hosting
- Cloudflare R2 / Vercel Blob: file storage (avatars, portfolio media)
- Google (google.com): optional sign-in (only the standard OAuth identity claims)
Cookies and tracking
We use a small number of cookies and similar technologies for essential functions: keeping you signed in (session cookies), remembering whether you have passed our gated-beta password (the site_gate cookie), and similar operational needs. We do not use cookies for advertising purposes and do not run third-party advertising trackers on the Site. You can disable cookies in your browser settings, though doing so may prevent some Site functionality.
Our role
surely + work is a facilitator between freelancers and clients. Any engagement, contract, payment, or dispute between a freelancer and a client is a matter between those two parties. surely + work does not employ freelancers, does not withhold taxes on their behalf, and is not party to any work agreement. See our Terms of Service for the full description of our role.
Your rights
You can request a copy of your data, correction of inaccuracies, or removal of your profile from our database at any time by contacting us at hello@surelywork.com. We honor deletion requests by hard-deleting your profile row, related links, media, and any payment records that are not legally required to be retained. Subscription history and tax-relevant records may be retained for the period required by law.
California privacy rights (CCPA / CPRA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):
- Right to know what personal information we collect, use, disclose, and sell
- Right to delete personal information we have collected from you
- Right to correct inaccurate personal information
- Right to opt out of the sale or sharing of your personal information
- Right to limit the use of sensitive personal information
- Right to non-discrimination for exercising any of these rights
We do not sell or share personal information in the traditional sense of those terms, and we do not knowingly collect or sell personal information from minors under 16. To exercise any of these rights, email hello@surelywork.com with the subject line “California Privacy Request”.
Data retention
We keep your profile data for as long as your account is active. When you request deletion, we hard-delete your profile and related records (favorites, media, links, portfolio items) from our database. Payment records, tax documentation, and similar records required to comply with legal obligations may be retained for up to 7 years from the date of the transaction. Aggregated, anonymized analytics that cannot be tied back to you may be retained indefinitely.
Children
The Site is intended for users 18 years of age and older (with limited supervised exceptions described in our Terms). We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it as soon as practicable.
International users
surely + work is based in the United States. If you access the Site from outside the US, you understand that your information will be processed in the US. If you are located in the European Economic Area, the UK, or another jurisdiction with comprehensive privacy laws, you may have additional rights, including the right to lodge a complaint with your local data protection authority. You can exercise those rights, or request a copy of any data we hold about you, by contacting hello@surelywork.com.
SMS messages and mobile data
If you opt in to receive SMS notifications from surely + work (via the consent checkbox in your profile), the following applies:
- Non-sharing of mobile numbers. We do not sell, rent, or share your mobile phone number with third parties for their marketing purposes. Your mobile number is used solely to send SMS messages related to your surely + work account (project briefs, curator outreach, shortlist updates, deadline reminders).
- Message frequency. Typically 1–3 messages per month, depending on your activity and the number of briefs matching your profile.
- Message and data rates may apply. Your carrier's standard rates may apply.
- HELP / STOP. Reply HELP to any surely + work SMS for assistance. Reply STOP to opt out of all further SMS messages. You can also uncheck the consent box in your profile at any time. See our SMS Terms for full details.
- Subprocessor. surely + work uses Twilio (twilio.com) to deliver SMS messages.
Security
We store your data on encrypted, access-controlled infrastructure and restrict access to authorized surely + work personnel. We take reasonable measures to protect your data but cannot guarantee the security of any transmission over the internet.
Copyright (DMCA)
If you believe that material on the Site infringes your copyright, see the DMCA / Copyright Takedown section of our Terms of Service for the notice-and-takedown procedure.
Changes to this policy
We may update this Privacy Policy from time to time. For material changes, we will post the updated policy on the Site with a new Effective Date and, where reasonably feasible, notify you by email. Continued use of the Site after the Effective Date of a revision constitutes your acceptance of the revised Policy.
